Changes in processing of the Non-EEA National Family Applications?

 Following a Supreme Court judgment, the Home Office has paused decision-making on some applications – in particular, those failing to meet the minimum income threshold for British citizens sponsoring a non-EEA partner and non-EEA children. The reason for this pause is to enable the Home Office to consider the implications of the judgment handed down by the Supreme Court on 22 February 2017 in MM (Lebanon) & others v SSHD [2017] UKSC 10. All other applications will continue to be processed and decided as normal.

If you have already applied and now wish to withdraw your application, you may do so. The Home Office will not generally refund your application fee.

• What proves that my passport is at the possession of the Visa Application Centre once I submit my application?
After submission applicants will receive a receipt/checklist acting as acknowledgement for the documents you have submitted.  You will be able to track their application via https://uk.tlscontact.com/ website.

• How can I collect my passport?
After you have received the notification email saying that your passport is returned to the Visa application centre, you can come and collect it.
To collect your passport at the Visa Application Centre, please ensure to come with the following documents:
    1. TLScontact checklist (Form provided to you after the documents reviewing);
    2. Copy and Original of your photo ID document;
    3. (If collected by a representative) Original Authorisation form and representative’s valid photo ID document (copy & original) should be added to above documents.

If coming back to the Visa Application Centre is not convenient, why not select the courier delivery service ?

• What should I do if I need my passport back urgently?
If you knew in advance that you will need to keep your passport during the application process, you can check whether the Added Value Service “Keep My Passport When Applying” is available at the Visa Application Centre that you are using. If you need to know the decision and have your passport back to you in a shorter time than standard processing time, you could check whether Priority Visa Services are available.

If you need your passport back urgently for any reason after you’ve submitted your application, you will need to withdraw your visa application. You will need to make this request in writing and this will take between 2 and 7 working days depending on the location where you applied to.
There are two options:
(1) In person at the Visa Application Centre (only available in Visa Application Centres opened 5 days/week). You will need to complete and sign a withdrawals pro-forma. This form will then be sent to the Decision Making Centre who will arrange for the return of your passport either to the Visa Application Centre where you applied or to your nominated return address, by courier, if you purchased this additional service.
(2) Send an email to the International Enquiry Service. This email will then be sent to the Decision Making Centre who will arrange for the return of your passport either to the Visa Application Centre where you applied or to your nominated return address, by courier, if you purchased this additional service.
Please note, if you withdraw your application, it will be voided on our systems, you will not receive a decision on this application and your fee will not be refunded. You can of course, make a fresh application at any stage.

• How should I arrange my documents?

In order to avoid delays in the visa application centre, we recommend that those using the standard and Priority Visa services note the following:
Where possible all documents should be A4 size;
You photocopy any original documents (copies of old/previous passports must be copied in colour);
You photocopy any documents which are smaller or larger than A4 onto A4 sized paper;
You remove any clips or pins from documents before submitting them;
If your documents are torn, crumpled or heavily creased documents, please photocopy them onto A4 sized paper before they are submitted, as they can’t be scanned in this condition.
If you have documents that are not in English or Welsh, you need to provide a full translation that can be independently verified by the UK Visas and Immigration (UKVI).

Each translation must include a signed statement from the translator, confirming that it accurately reflects the original document. This statement must be dated in the DD/MM/YYYY and include the translator’s full name and contact details.

• What will happen if my application is refused?
All fees and additional service charges are non-refundable once the application has been processed even if the visa has been refused.
However, applicants are free to re-apply at any time if your application has been refused. There is no specific waiting time between reception of refusal and making a new application.

• In what case can I apply for a refund and what’s the process?
All Visa Application fees are paid online during completing visa application form and are received by UK Visas and Immigration. Please pay attention that TLScontact does not receive visa fee payments and cannot process any refund requests regarding such payments.
